This is the complete agreement governing your listing on Purestay. It covers your independent status, Our Standards, how bookings and payments work on each tier, fees, content licensing, conduct, enforcement, and taxes.
1. Your Independent Status
Purestay is a curated collection of low-tox, wellness-focused vacation rental homes. As a host you remain fully independent. You own your home, your guest relationships, your pricing, your cancellation policy, and your tax obligations.
You are not an employee, joint venturer, partner, or agent of Purestay LLC. Purestay does not dictate your hours, staffing, pricing, or methods of operation. You are responsible for all self-employment taxes, social security contributions, and your own insurance.
Purestay is not your property manager, agent, employer, or insurer.
2. Tier Election
At signup you elect one of two tiers. Your election determines your fee structure and whether Purestay provides hosted booking technology. You may request a change by contacting support@purestay.co.
Subscription tier. You pay a flat monthly membership. Purestay lists your home and sends interested travelers to whatever booking channel you designate. Purestay does not process your bookings or payments and takes no commission.
Commission tier. You pay no membership. Purestay builds and hosts a direct-booking website for your home. Payments run through your own connected Stripe account, so you are the merchant of record and you own refunds, disputes, chargebacks, and taxes exactly as you would on your own site. Purestay receives a per-booking platform fee collected automatically at checkout.
3. Our Standards
You warrant that your home meets all four required conditions and will continue to meet them for as long as it is listed.
3.1 Fragrance-free
You must use fragrance-free products throughout the operation of the home:
- Cleaning products used in turnover and routine cleaning
- Laundry products used on bedding, towels, and linens, including detergents, fabric softeners, and dryer sheets
- Guest toiletries provided in the home
Synthetic fragrance is never permitted. Natural fragrance sources — including products marketed as natural, plant-based, or essential-oil-scented — count as fragrance for the purposes of this standard and may only be used where you have disclosed that use on your listing. The requirement is disclosure and control of fragrance sources.
Prohibited: plug-in air fresheners, aerosol air fresheners, scented candles provided for guest use, scented trash bags and liners, fragranced cleaning or laundry products, and scenting the home before guest arrival.
Natural fragrance is permitted only where disclosed. You may use essential oils and other natural fragrance sources in products or diffusers only if you affirmatively disclose that use on your listing, including where and how they are used. Undisclosed use is a violation of this standard.
Ventilation. You are expected to ventilate the home during turnover where weather, security, and building conditions reasonably permit.
Third-party services. If you use an outside cleaning company or commercial laundry service, you remain responsible for directing that service to use fragrance-free products and for verifying that they do.
Changes. If any product you use changes, update your listing promptly. Continuing to represent the home as compliant when it is not is a material misrepresentation.
3.2 Natural-fiber bedding and towels
Bedding and towels must be cotton, linen, silk, or wool. Hidden protective layers such as mattress protectors, pillow protectors, and waterproof liners are exempt.
3.3 Low-tox kitchen
Available for guest use: stainless steel or cast iron cookware; glass or stainless cups and bowls; a glass, stainless, or wood cutting board; and stainless steel or wood utensils.
3.4 Air purification
At least one air purifier must be available in the home.
3.5 Encouraged, not required
A no-shoes policy, avoidance of outdoor pesticide and herbicide application, the ability to disable wireless internet, water filtration, saunas, and cold plunges are welcome additions that may be displayed on your listing. They are not requirements and must not be presented as though they were.
4. Listing Accuracy
You agree that everything you publish — photos, amenities, house rules, availability, pricing, and the Home Health Profile — is truthful and current.
Qualified claims. Avoid absolute terms such as "100% chemical free," "toxin free," or "guaranteed fragrance free." Use accurate, qualified language.
Claim only what is present. Only list amenities, materials, and practices that actually exist in the home and are actively maintained.
No medical claims. You may not represent that a stay will treat, prevent, cure, or alleviate any condition, or make detox, healing, or symptom-relief claims.
Environmental context. If proximity to cell towers, high-voltage power lines, or heavy industrial zones is a prominent feature of the property's surroundings, disclose it.
Photos. Minimum of three high-quality photographs that accurately represent the current state of the home. No filtering or staging that misrepresents the space.
5. You Own the Booking Relationship
On both tiers, the rental agreement is between you and your guest. You set pricing, availability, house rules, and your cancellation policy. You communicate with your guests. You remain responsible for the condition and legality of the home.
Rental agreements. You provide and enforce your own rental agreement with each guest. On the commission tier, Purestay makes a template available for your convenience. If you adopt it, it becomes your agreement with your guest and Purestay is not a party to it.
Subscription tier. Guests book directly with you through the channel you designate. You collect payment, hold funds, and issue receipts and refunds. Purestay does not process payments.
Commission tier. Guests book through a website Purestay hosts on your behalf, but payment is processed through your own connected Stripe account. You are the merchant of record. You hold the funds, you issue receipts and refunds, and you are responsible for chargebacks and disputes.
6. Fees
Subscription tier: a recurring membership fee of [SUBSCRIPTION PRICE], disclosed before you sign up, billed in advance. No commission is taken on your bookings.
Commission tier: no membership fee. Purestay receives a platform fee of [COMMISSION RATE] of the booking total on each confirmed booking made through the Purestay-hosted booking website, collected automatically at the time of payment. The remainder settles directly to you. Where you refund a guest, the platform fee is refunded proportionally.
Purestay fees are non-refundable except where required by law. Subscription fees are not refunded or prorated for any period during which your listing is suspended for failure to meet Our Standards.
Payment processing on the commission tier is provided by Stripe and subject to Stripe's terms. You maintain your own Stripe account. Purestay does not store, hold, or access guest payment credentials or funds.
Under the Stripe account structure Purestay uses, Stripe assumes responsibility for negative balances on connected accounts. Purestay does not fund, guarantee, or advance against your account balance.
7. Anti-Circumvention
If you are on the commission tier, you agree not to divert a guest who arrives through your Purestay-hosted booking website to an alternative booking channel for the purpose of avoiding the platform fee.
This does not apply to subscription tier hosts, who have no Purestay-processed transaction to circumvent.
8. Listing Content and License
You retain all ownership of the photographs, video, and descriptions you submit. You grant Purestay a non-exclusive, worldwide, royalty-free, sub-licensable license to use, reproduce, adapt, and display that content for the purpose of operating and marketing the collection, including on social media and in email campaigns.
You represent that you own the content or hold a commercial-use license for it, that it does not feature identifiable individuals without their consent, and that it does not infringe any third-party rights. You agree to indemnify Purestay against copyright claims brought by third-party photographers.
You may not use editing or generative tools to remove permanent fixtures, conceal defects, or depict features that do not exist. Virtually staged or AI-enhanced images must be disclosed in the listing.
Purestay will remove your content from active listings within 30 days of your departure. You acknowledge that content already used in historical marketing, such as past social posts or published articles, may remain in circulation.
Personal data in content. Where submitted content contains personal data, such as a photograph of you or a member of your household, you may request its removal from Purestay's marketing materials at any time. Purestay will comply within 30 days, except where retention is required for legal recordkeeping.
9. Guest Privacy and Safety
Surveillance. Undisclosed cameras are strictly prohibited. Exterior cameras such as doorbells or floodlights must be disclosed in the listing. Interior cameras are banned, even if disclosed.
Guest data. You may not request sensitive guest data outside the secure platform or payment-processor verification flow.
10. Guest Treatment
Respond to guest inquiries in good faith and promptly, ideally within 24 hours. Honor confirmed bookings. Treat all guests without discrimination on any basis protected by applicable law, consistent with our Anti-Discrimination Policy.
11. ENFORCEMENT
11.1 Reports and temporary suspension
If Purestay receives a credible report that a home is not meeting Our Standards — from a guest, from the host, or from Purestay's own review — Purestay may immediately and temporarily suspend the listing from the collection pending evaluation.
Suspension is precautionary and is not a finding that a violation occurred. Purestay may suspend without prior notice where it reasonably believes continued listing could mislead a guest or cause harm.
11.2 Evaluation
Purestay may consider: your response and any supporting evidence, photographs or documentation of the products actually in use, the guest's account, whether the issue was disclosed, whether you acted promptly to remedy it, and your history on the platform.
You agree to cooperate reasonably, including providing photographs of cleaning products, laundry products, and guest toiletries in use, and information about any third-party cleaning or laundry service.
11.3 Outcomes
Purestay may, in its reasonable discretion: reinstate with no further action; require correction of the listing or disclosure before reinstatement; require a documented corrective plan; extend the suspension for a defined period; remove the listing permanently; or terminate the account.
Repeat violations, misrepresentation of what a home actually uses, failure to disclose essential oil use, and failure to cooperate weigh toward removal.
11.4 Effect
Suspension or removal does not affect bookings a guest has already made directly with you. You remain responsible for honoring confirmed bookings and for any refund due under your own cancellation policy.
Purestay does not hold guest funds and does not issue refunds. Enforcement is Purestay's remedy for maintaining the integrity of the collection. It is not compensation to any guest.
11.5 Acknowledgement
You acknowledge that suspension or removal under this section is a contractual remedy available to Purestay, is not a breach of any agreement by Purestay, and does not give rise to a claim against Purestay for lost bookings, lost revenue, or reputational harm.
12. Verification
Purestay may periodically request photographs or documentation supporting your compliance, including cleaning products, laundry products, guest toiletries, and filtration equipment, and reserves the right to conduct unannounced quality checks.
Any review by Purestay is an operational review for alignment with Our Standards. It is not an inspection, a certification, or a scientific validation, and it does not transfer responsibility for the condition of the home from you to Purestay.
13. Legal Compliance and Insurance
You are responsible for maintaining the property in the condition described and complying with all local laws, short-term rental permits and licensing, HOA bylaws and CC&Rs, lease terms, and safety codes including functioning smoke and carbon monoxide detectors and fire extinguishers.
You are strongly encouraged to carry short-term rental liability insurance with a minimum recommended limit of $1,000,000. Purestay does not provide insurance coverage for you, your guests, or your property, and does not guarantee that your homeowners' insurance covers short-term rental activity.
Purestay does not audit or verify the legal standing, permitting status, or HOA compliance of any listing.
14. Taxes
You are solely responsible for determining, collecting, and remitting all lodging, sales, occupancy, and income taxes associated with your bookings, on both tiers.
Subscription tier. Purestay does not process bookings, collects nothing from guests, and has no tax collection, remittance, or reporting role.
Commission tier. Guest payments are processed through your own connected payment account and you are the merchant of record. Purestay does not collect, hold, or remit any tax on any booking. Tax reporting associated with your payment account, including any Form 1099-K, is issued by the payment processor directly to you based on your own transaction volume.
Your payment processor may require a valid Form W-9 or Taxpayer Identification Number before enabling payouts, and may withhold payouts until it is provided. That requirement is between you and the processor. Purestay does not collect, hold, or verify your tax identification information.
California SB 346. For properties in California, Purestay may be required to share listing data including address, URL, and license numbers with local jurisdictions.
Nothing on purestay.co constitutes legal, tax, or financial advice. Consult a qualified CPA or attorney regarding your specific tax nexus and regulatory obligations.
15. Indemnification and Termination
You agree to indemnify, defend, and hold Purestay LLC harmless from any claim, fine, penalty, back tax, or expense arising out of your listing, your bookings, your rental agreements, your acts or omissions as a host, or your failure to remit taxes, obtain permits, or comply with applicable law.
Either party may terminate at any time. Purestay may remove a listing under Section 11.
16. Governing Law
Governed by the laws of the State of Idaho. Disputes resolved in the state or federal courts located in Ada County, Idaho.
