Terms of Service

Purestay is a curated collection of independently owned vacation rental homes selected for their alignment with Our Standards.

Purestay is not a travel agency, property manager, rental agent, landlord, insurer, or healthcare provider. Purestay does not own, operate, manage, or inspect any home in the collection. Each home is independently owned and operated by its host, who sets pricing, availability, house rules, and cancellation terms, and who is solely responsible for the condition, safety, legality, and accuracy of the home and its listing.

Purestay's role depends on the tier the host has elected.

Subscription tier. Purestay lists the home and refers interested travelers to the booking channel the host has designated. Purestay does not process bookings or payments, does not hold guest funds, and has no involvement in the resulting transaction.

Commission tier. Purestay provides and hosts a direct-booking website on the host's behalf. Payments made through that website are processed through the host's own connected payment account. The host is the merchant of record. Purestay does not collect, hold, or disburse guest funds and receives only a platform fee for providing the technology and the referral.

In both cases, any rental agreement is directly between the guest and the host. Purestay is not a party to it and does not act as agent for either party.

If any language in any Purestay document appears to describe Purestay as the merchant of record, an escrow agent, a property manager, or an agent of either party, it is superseded by this section.

You must be at least 18 years old and able to enter into a legally binding agreement. You agree to provide accurate information, use the platform only for lawful purposes, and treat other users with respect.

Purestay may suspend or remove accounts and listings that violate these terms, misrepresent a property, or harm the community.

You may not: use automated tools to scrape, harvest, or mine listing data; attempt to decompile or reverse engineer any part of the platform; use the platform for fraudulent purposes or misrepresentation; circumvent access controls; or reproduce or distribute Purestay's editorial content without written permission.

All listing details, photographs, availability, pricing, house rules, and disclosures are provided and controlled by the host. Hosts represent that their information is accurate and current and that they hold all rights and permits required to legally rent the property.

Hosts set their own cancellation and refund terms, communicate with their own guests, and remain responsible for the condition and legality of the home regardless of tier.

To be listed, a host must warrant that the home meets four required conditions:

1. Fragrance-free. The host uses fragrance-free cleaning products, laundry products, and guest toiletries, and does not introduce undisclosed fragrance into the home. Synthetic fragrance is never permitted. Essential oils and other natural fragrance sources are permitted only where disclosed on the listing.
2. Natural-fiber bedding and towels — cotton, linen, silk, or wool.
3. Low-tox kitchen — cookware of stainless steel or cast iron, cups and bowls of glass or stainless steel, a cutting board of glass, stainless steel, or wood, and utensils of stainless steel or wood.
4. At least one air purifier available in the home.

These standards describe products and practices required of hosts. They are warranted by the host, not verified by Purestay.

PURESTAY MAKES NO GUARANTEE, REPRESENTATION, OR WARRANTY THAT ANY HOME IS FREE OF FRAGRANCE, SCENT, OR ANY OTHER SUBSTANCE, OR THAT ANY GUEST WILL NOT EXPERIENCE A REACTION.

Purestay does not inspect, test, sample, or verify any home. Purestay's review of a listing is an operational review for alignment with Our Standards and is not an inspection, audit, or certification.

Purestay enforces Our Standards by suspending and removing homes that fall short. Enforcement maintains the integrity of the collection. It is not a guarantee to any guest.

The Health and Environmental Disclaimer sets out the limits of these standards in full. It is incorporated into these Terms by reference and every guest should read it before booking.

Subscription tier hosts pay a recurring membership fee of [SUBSCRIPTION PRICE], disclosed before signup. Purestay collects no commission or transaction-based charge from these hosts.

Commission tier hosts pay no membership fee. Purestay receives a platform fee of [COMMISSION RATE] of the booking total on bookings made through the Purestay-hosted booking website, collected automatically through the host's connected payment account. Where a host refunds a guest, the platform fee is refunded proportionally.

Purestay does not charge guests a booking or service fee on either tier.

The Purestay name, logo, site design, and editorial content are owned by Purestay. Hosts retain ownership of their listing content and grant Purestay a limited license to display, promote, and syndicate that content, as set out in the Host Agreement.

Purestay responds to valid DMCA notices at support@purestay.co.

The platform is provided on an "as is" and "as available" basis.

TO THE FULLEST EXTENT PERMITTED BY LAW, PURESTAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT ANY HOME IS SUITABLE FOR ANY GUEST'S HEALTH CIRCUMSTANCES.

To the maximum extent permitted by law, Purestay is not liable for any injury, illness, allergic or sensitivity reaction, property loss, or other damages arising from a stay, from a host's acts or omissions, from the condition of any property, or from any rental agreement between a guest and a host.

Purestay's total liability for any claim relating to the platform is limited to the fees you paid Purestay in the twelve months preceding the claim.

You agree to indemnify and hold Purestay harmless from any claim or expense arising out of your use of the platform, your stay at any property, your listing of a property, or your breach of these terms or any applicable law.

Purestay is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, wildfires, pandemics, utility or network failures, or governmental action.

Purestay may update these terms and may modify or discontinue any part of the platform. Material changes will be announced on the platform. Continued use after an update constitutes acceptance. Purestay may terminate any account at its discretion to protect the integrity of the collection.

These terms are governed by the laws of the State of Idaho. Any dispute will be resolved in the state or federal courts located in Ada County, Idaho, unless the parties agree in writing to arbitration. Nothing in this section waives non-waivable rights under the consumer protection laws of your state of residence.
