This is a blank template.
This is the host's own rental agreement with their guest. Purestay supplies it as a template for commission-tier hosts and is not a party to it. A host who adopts it makes it their agreement with their guest.
Placeholders shown in braces — for example {Host legal name} — are filled in from the listing and the booking before a guest is asked to accept. No guest is ever shown an agreement with an unfilled placeholder.
Host–Guest Short-Term Rental Agreement
This Short-Term Rental Agreement ("Agreement") is entered into between:

1. The Parties
This Agreement is between the Host and the Guest.
Purestay LLC is not a party to this Agreement. Purestay operates the platform on which the Guest found and booked the Property. Purestay is not an owner, operator, manager, or agent of the Property, is not a landlord or lessor, and has no obligation to either party under this Agreement.
2. Rental of the Property
The Host grants the Guest the right to occupy the Property for the dates stated above, for the number of guests stated above.
This is a short-term rental for vacation or temporary occupancy only. It is not a lease and does not create a tenancy or any residency right. The Guest agrees to vacate at check-out.
3. Payment and Merchant of Record
The Guest pays the Host. Payment is processed by Stripe as a direct charge on the Host's account.
The Host is the merchant of record for this transaction. The Host issues the receipt, holds the payment, and is responsible for any refund.
Purestay does not hold, control, or disburse these funds and does not issue receipts or refunds.
4. Cancellation and Refunds

Refunds are issued by the Host in accordance with this policy. Purestay does not issue refunds and cannot compel the Host to issue one.
If the Host cancels a confirmed booking, the Guest receives a full refund regardless of timing.
5. Occupancy and Use
The Guest agrees that:
- occupancy will not exceed the number of guests stated above without the Host's written consent;
- the Property will be used for lawful residential purposes only — no parties, events, or commercial use without the Host's written consent;
- the Guest will comply with all house rules provided by the Host, which are incorporated into this Agreement;
- the Guest will comply with applicable laws and any HOA, condominium, or community rules;
- the Guest will not create a nuisance or unreasonably disturb neighbors; and
- the Guest is responsible for all members of their party, including minors and any visitors.

6. Condition of the Property and Guest's Inspection
The Guest agrees to notify the Host promptly of any damage, defect, or unsafe condition discovered at the Property.
The Guest acknowledges that the Guest has had the opportunity to review the listing and to ask the Host questions about the Property before booking, and accepts the Property in its current condition.
7. Wellness Standards — Host Commitments and Their Limits
The Host has represented on the Purestay listing that the Property meets Purestay's standards regarding fragrance-free products and practices, natural-fiber bedding and towels, a low-tox kitchen, and the availability of at least one air purifier, together with any disclosures made on the listing about essential oils or other natural fragrance.
These are commitments about the products the Host uses and the practices the Host follows. They are not guarantees of any environmental condition, air quality level, or health outcome.
The Host does not guarantee that the Property is free of all detectable scent, free of any particular substance, or that the Guest will not experience a reaction. Factors outside the Host's control — including items brought by previous guests, neighboring properties, outdoor conditions, building materials and furnishings, third-party cleaning or laundry services, legally required service animals, and the wide variation in individual sensitivity — can affect the Property.
The Guest acknowledges having read Purestay's Health & Environmental Disclaimer and accepts responsibility for determining whether the Property is suitable for the Guest and the Guest's party.
8. Assumption of Risk and Release
The Guest voluntarily assumes all risk of injury, illness, allergic or chemical reaction, sensitivity, or other harm arising from or relating to the Guest's stay at the Property, including risks associated with the Property's indoor environment, amenities, grounds, and surroundings.
To the maximum extent permitted by law, the Guest releases the Host from claims arising from such risks, except to the extent caused by the Host's gross negligence or willful misconduct.
9. Damage
The Guest is responsible for damage to the Property or its contents caused by the Guest or the Guest's party, beyond normal wear and tear.
Purestay does not collect, hold, or facilitate a security deposit on the Host's behalf. If damage occurs, the Host may bill the Guest directly for the reasonable cost of repair or replacement, using the contact information provided at booking. The Guest agrees to pay any amount owed within 14 days of receiving an itemized invoice from the Host.
Fragrance remediation. This Property is maintained in accordance with Purestay's fragrance-free standard. If the Guest's use of synthetic-fragrance products (including scented laundry detergent, dryer sheets, fabric softener, air fresheners, or heavy use of cologne or perfume) during the stay requires the Host to perform specialized or additional cleaning beyond routine turnover to restore the Property to that standard for the next guest, the Host may bill the Guest directly for a reasonable remediation fee, limited to the Host's actual additional cleaning cost, following the same invoicing process above.
Damage and remediation-fee claims are between the Host and the Guest. Purestay has no role in assessing, mediating, collecting, or resolving these claims.
10. Host's Right of Entry
The Host may enter the Property for emergency, repair, or safety reasons, and otherwise on reasonable notice, consistent with applicable law.
11. Insurance
The Host maintains such insurance as the Host has determined appropriate for short-term rental of the Property.
The Guest is encouraged to obtain travel insurance and to confirm whether the Guest's own insurance covers personal property, liability, or trip interruption. The Host's insurance does not cover the Guest's personal property or personal liability.
12. Limitation of Liability
To the maximum extent permitted by law, the Host's total liability arising out of or relating to this Agreement or the Guest's stay will not exceed the total amount paid by the Guest for this booking, except for liability that cannot be limited by law, including liability arising from gross negligence or willful misconduct.
The Host is not liable for indirect, incidental, consequential, or punitive damages, or for loss of enjoyment, travel costs, or lost time.
Purestay has no liability under this Agreement. Any claim relating to Purestay's platform is governed by Purestay's own Terms of Service, Guest Terms, and Health & Environmental Disclaimer, and not by this Agreement.
13. Force Majeure
Neither party is liable for failure to perform due to causes beyond its reasonable control, including natural disaster, fire, flood, wildfire, severe weather, utility failure, government order, or evacuation. In such an event the Host will offer the Guest a refund or a rebooking of the stay.
14. Governing Law and Disputes
This Agreement is governed by the laws of the state where the Property is located, without regard to conflict-of-law principles. Disputes arising under this Agreement are between the Host and the Guest and will be resolved in the courts of that state, unless the parties agree otherwise.
Purestay's dispute resolution provisions do not apply to disputes between the Host and the Guest under this Agreement.
15. Entire Agreement
This Agreement, together with the house rules and the listing as displayed at the time of booking, is the entire agreement between the Host and the Guest regarding the stay. It does not modify Purestay's Terms of Service, Guest Terms, Privacy Policy, or Health & Environmental Disclaimer, which govern the Guest's relationship with Purestay separately.
If any provision is unenforceable, the remainder stays in effect.
